In New Jersey, one is considered “driving under the influence” if their blood alcohol concentration is of 0.08% or greater when taking a Breathalyzer test. “Driving under the influence” includes motor vehicles and boats. Generally penalties can include but are not limited to fines, fees, surcharges, jail time, and community service. Penalties differ depending on one’s blood alcohol concentration. NOTE: If you are under 21, you are considered “driving under the influence” if your BAC is of 0.01% or greater.

Since car insurance is mandatory in New Jersey, the Automobile Insurance Cost Reduction Act mandated that a basic auto insurance policy be available to all drivers. The basic policy is great for individuals with little family responsibility and few assets. Young drivers just starting work are often being provided with minimum protection when then can afford better coverage. Any New Jersey licensed insurance producer can sell a basic policy, but they are exempt from liability on account of selling insurance with the minimum required coverage.
